Нюрнбергский и последующие процессы, проходившие в 1945—1949 годах, получили обширную и неоднозначную историографию. Мнение исследователей о «наиболее изученных судебных процессах в истории» разнилось от их прославления до полного непринятия: если одни историки и юристы воспринимали первый Нюрнбергский процесс как пример международного сотрудничества, направленного на верховенство закона, то другие видели в нём и последующих судах пример «правосудия победителей»[1][2].

История формирования[править | править код]

Начало формированию историографического наследия положили сами участники основного Нюрнбергского процесса: ещё в марте 1946 года было отмечено, что «каждый, кто возвращался [из Нюрнберга], начинал писать книгу». В итоге, огромное количество публикаций было написано современниками и участниками событий. Нюрнберг стал редким историческим событием, тщательно изученным его собственными героями. Дневники, мемуары и статьи, написанные судьями, обвиняемыми, прокурорами, адвокатами, переводчиками и персоналом тюрьмы, сопровождались академическими обзорами исторических работ от тех же авторов. Некоторые из них регистрируются в библиотеках как вторичные исследования, а не первичные источники: например, книги «The Nuremberg Trial» Уитни Харриса и «Anatomy of the Nuremberg Trials» прокурора Телфорда Тейлора. В книге Тейлора мемуарную часть и историографическую работу можно отличить только при непосредственном знакомстве с рукописью, хранящейся в Юридической школе Колумбийского университета[3].

Популярные англоязычные источники — такие как книги Купера, Конота или Туса, написанные в годы Холодной войны — представляли собой «проницательные, яркие рассказы», но не предоставляли своим читателям ни контекста, ни анализа событий. Первой работой профессионального историка стала книга Юджина Дэвидсона «Trial of the Germans», изданная в 1969 году и содержавшая в себе биографические очерки обвиняемых — а не исторический анализ Нюрнбергского процесса. В начале 2000-х годов в свет вышли работы Лоуренса Дугласа и Дональда Блоксхэма, впервые детально обсудившие проблемы, связанные с несовместимостью юридической и исторической трактовок событий в Нюрнберге — те же работы содержали и попытку анализа влияния судебного процесса на последующую историографию Холокоста. В 2011 году вышло «обширное и всеобъемлющее» исследование Кевина Джона Хеллера о последующих Нюрнбергских процессах, содержавшее актуальный на тот момент статус юридических дебатов о Нюрнберге и детальные ответы на многие спорные вопросы о процессе. Американские, британские и французские источники стали основой для работы Кима Кристиана Примеля «The Betrayal: The Nuremberg Trials and German Divergence» (2016), в то время как советская сторона дела была обсуждена в работе Франсин Хирш «Soviet Judgment at Nuremberg» (2020)[3].

Судебный процесс в Нюрнберге включал в себя изучение 100 тысяч документов, 100 тысяч футов кинопленки и 25 тысяч фотографий. Обвинение и защита сделали 30 000 фотокопий и напечатали 50 миллионов машинописных страниц. Наиболее важными первичными источниками по Нюрнбергским процессам являются стенограммы самих судебных заседаний: в англоязычном издании стенограмма первого процесса занимает около 17 000 страниц. В случае с МВТ они были опубликованы на всех четырёх официальных языках трибунала в 42-х томах («Голубая серия», Blue Series): 22 тома стенограмм и 20 томов представленных суду доказательств. Кроме того, краткая версия позиции обвинения содержалась в англоязычном десятитомнике «Nazi conspiracy and aggression», изданном в 1946—1948 годах («Красная серия», Red Series / NCA). В случае с последующими процессами полные стенограммы, по данным на 2016 год, никогда не публиковались: «Зеленая серия» (Green Series) книг представляет собой только дайджест из 135 000 страниц стенограмм — не считая множества юридических сводок и более 185 000 страниц доказательств[4][5].

В СССР русские переводы речей немецких адвокатов были засекречены: на протяжении десятилетий они хранились в особых советских архивах и были изданы уже после распада Советского Союза — в 2008 году, в рамках двухтомника «Нюрнбергский процесс: Защитительные речи адвокатов»[6]. Советские официальные власти также продолжали отрицать и существование секретного протокола к пакту Молотова — Риббентропа. Несмотря на постепенное введение ограничений на доступ к российским архивам, связанным Нюрнбергом, на территории РФ продолжалось издание отдельных коллекций документом: включая «СССР и Нюрнбергский процесс. Неизвестные и малоизвестные страницы истории» (2012) и «Главный процесс человечества. Нюрнберг: документы, исследования, вспоминания» (2011)[7][8].

Влияние[править | править код]

Фактический отказ Нюрнбергского трибунала поддержать концепцию «нацистского заговора» внёс вклад в историографию Третьего Рейха и Холокоста. Отказ привёл к постепенному разрушению нарратива об абсолютной тоталитарной диктатуре, существовавшей в Рейхе: нарратива об «отряде умалишенных фанатиков», управлявших германским обществом, которое стало первой жертвой нацизма[9].
